03/07/2024 - The Vietnam Competition Commission sends an official dispatch to the Departments of Industry and Trade of provinces and centrally governed cities, informing them of the legal documents on consumer protection that come into effect from July 1, 2024.

On July 2, 2024, the Vietnam Competition Commission issued Document No. 806/CT-HĐM regarding legal regulations on consumer rights protection effective from July 1, 2024, sent to the Department of Industry and Trade of centrally-run provinces and cities.

In Document No. 806/CT-HĐM, the Vietnam Competition Commission informs that starting from July 1, 2024, the legal regulations on consumer rights protection include the Consumer Protection Law 2023, Decree No. 55/2024/NĐ-CP dated May 16, 2024 detailing certain provisions of the Consumer Protection Law 2023, and Decision No. 07/2024/QĐ-TTg dated June 20, 2024 by the Prime Minister issuing the list of products, goods, and services subject to standardized contract registration and general transaction conditions, which are now in effect. Therefore, to ensure compliance with consumer rights protection laws, the National Competition Commission requests the Department of Industry and Trade of centrally-run provinces and cities to:

  1. Studying the provisions of the Consumer Protection Law 2023, Decree No. 55/2024/NĐ-CP, Decision No. 07/2024/QĐ-TTg as mentioned above, ensuring correct and effective enforcement of the legal provisions. Reference materials on the new points of the Consumer Protection Law 2023 related to standardized contract control, general transaction conditions, and other relevant documents will be provided via a QR code attached to the Document. The Vietnam Competition Commission will continue to update additional reference materials (if any) on the aforementioned QR code in due course.

  2. Complying with and require organizations and individuals in business to comply with the standardized contract provisions attached to Appendix of Decree No. 55/2024/NĐ-CP (such as models for: standard contract registration applications, general transaction conditions; notices on supplementary documents; notices on completion of registration; notices on the results of registration dossier evaluation; reports on the implementation of standardized contracts and general transaction conditions in centrally-run provinces and cities...).

  3. Regarding standardized contracts and general transaction conditions that have been publicly applied to consumers before the effective date of the Consumer Protection Law 2023, provisions regarding transfer are stipulated in Article 80 Section 2 of the Consumer Protection Law 2023, specifically:

  • Standardized contracts and general transaction conditions that are not subject to mandatory registration under legal regulations must be amended, supplemented in terms of content, form of standardized contracts, and publicly disclosed to comply with the provisions of the Consumer Protection Law 2023 before December 31, 2024.

  • Standardized contracts and general transaction conditions subject to mandatory registration under legal regulations at the time when the Consumer Protection Law 2023 takes effect must be registered with standardized contract terms that comply with the provisions of the Consumer Protection Law 2023 before December 31, 2024.
